What is a Civil Partnership?

A Civil Partnership gives legal recognition to your relationship and provides both partners with similar rights to married couples. You can form a civil partnership in England if:

  • You are 16 or over
  • You are not already married or in a civil partnership
  • You are not closely related
  • Same sex couples can convert a civil partnership into a marriage.

Entering a civil partnership is an important step and can affect your rights in several areas so it is important that you are aware of exactly how it will affect you and your partner. Our team of experts at Family Law Sheffield will strive to understand your specific circumstances and explain clearly just how entering a civil partnership will affect you and your loved one.

Entering into a civil partnership will bring changes to your rights relating to:

  • Pensions
  • Tax
  • Employment advantages
  • Child upkeep
  • Responsibility for your civil partner’s children
  • Access to accident to compensation and insurance coverage
  • Protection from domestic violence
  • Migration rights

It is important that you are fully aware of how entering into a civil partnership can affect your rights. At Family Law Sheffield our team of civil partnership experts can provide you with the best legal advice at a budget friendly cost.

How do we Enter into a Civil Partnership?

Before entering into a civil partnership you must meet the following criteria:

  • You and your partner must be over 18. It is possible to register a civil partnership if you and your partner are 16 or 17 but this will require written permission from both of your parents or legal guardians.
  • You must have lived in the same area of England or Wales for at least seven days
  • Neither you or your partner are already in a civil partnership or married.
  • You are not close blood relatives

You must first decide where you are going to have your civil partnership ceremony. Once you have done that you need to ‘give notice’ at a regional register office that you wish to register your relationship as a civil partnership which will involve signing a legal statement to that effect. ‘Giving notice’ must be done at least 29 days before your ceremony and the ceremony itself must be held within 12 months.

Why Enter into a Civil Partnership?

A civil partnership gives your relationship a legal status and certain rights which cannot be conferred through cohabitation. Relationships are very important and a civil partnership offers a way of protecting those within that relationship both legally and financially without getting caught up in the religious and traditional aspects of marriage.
